1. Acceptance of terms
By signing up for and using SmsHorizon services, you agree to be bound by these terms and conditions. If you do not agree, please do not use our services.
2. Account responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
3. Permitted use
You agree to use our SMS services only for lawful purposes and in compliance with all applicable laws and TRAI regulations. Specifically, you must not:
- Send messages to numbers registered on the DND (Do Not Disturb) registry without proper consent
- Transmit spam, illegal, defamatory, obscene or misleading content
- Impersonate any person or entity, or misrepresent your affiliation
- Engage in phishing, fraud or any deceptive practice
- Send messages without proper DLT registration where required
4. Pricing and payment
SMS credits are pre-paid and added to your account upon receipt of payment. Pricing is subject to change with advance notice. Unused credits do not expire. All prices are exclusive of GST unless stated otherwise.
5. Refund policy
SMS credits, once purchased, are non-refundable. However, if credits could not be used due to a verifiable issue on our platform, we may at our discretion offer credit replacement or partial refund.
6. Service availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. SmsHorizon is not liable for delivery failures caused by telecom operators, recipient handsets or network congestion outside our control.
7. DLT compliance
Customers sending transactional or promotional SMS to Indian numbers must comply with TRAI's DLT regulations, including entity, header and template registration. We assist with the registration process but compliance remains the customer's responsibility.
8. Limitation of liability
SmsHorizon's total liability for any claim arising from the use of our services is limited to the amount paid by the customer in the 3 months preceding the claim. We are not liable for indirect, incidental or consequential damages.
9. Termination
We reserve the right to suspend or terminate accounts that violate these terms, attempt to bypass system limits, or are used for fraudulent activity. Customers may close their account at any time by contacting support.
10. Changes to terms
We may update these terms periodically. Continued use after changes constitutes acceptance of the new terms.
11. Governing law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Salem, Tamil Nadu.
